1. Acceptance of Terms and Parties

The Service is operated by Otto Apps Yazılım Uygulama Bilgi Teknoloji Reklamcılık Danışmanlık Sanayi ve Ticaret A.Ş. ("Company", "we", "us"), Istanbul, Turkey.

By using the Service you confirm that you are at least 16 years old (or the minimum age of digital consent in your country), have the legal capacity (or parental consent where required) to enter into a binding agreement, and agree to these Terms and to our Privacy Policy.

We may revise these Terms at any time. Material changes will be communicated via in-app notification, email, or website banner, and take effect on the stated date.

2. Health & Safety Disclaimer

PushMe is a physical exercise service. Exercise carries an inherent risk of injury.

2.1 Not Medical Advice

PushMe is not a healthcare provider, physician, or licensed personal trainer. It is not a substitute for professional medical advice, diagnosis, or supervised instruction.

2.2 Get Medical Clearance First

Consult a qualified physician before beginning this or any exercise program, especially if:

• You are pregnant, recently gave birth, or nursing
• You have heart condition, high blood pressure, chest pain, or dizziness
• You have a current or recent injury or are recovering from surgery
• You have an eating disorder or history of one
• You are over 65 and not accustomed to regular exercise
• You take medication affecting heart rate, blood pressure, or balance

2.3 Your Reported Constraints

PushMe excludes movements that conflict with body regions you report as painful or limited. This is a safety feature, not a medical assessment. Keep your constraint information accurate and up to date. PushMe cannot know about conditions you don't tell it about.

2.4 You Train Unsupervised

You will be exercising alone and without professional supervision. You are responsible for:

• A safe training environment with adequate space
• Stable footing and safe equipment
• Appropriate footwear

Stop immediately and seek medical attention if you experience pain, chest discomfort, shortness of breath, dizziness, or any concerning symptom. Never push through sharp or joint pain.

2.5 AI Outputs Are Estimates

Training plans, exercise selection, difficulty progression, coaching messages, and estimated calories burned are AI-generated and may be inaccurate or unsuitable for you. Do not rely on them for medical decisions. Your logged numbers (weights, sets, reps) are stored as you entered them.

2.6 Assumption of Risk

By using the Service you acknowledge the risks described above and voluntarily assume them. To the maximum extent permitted by law, you undertake all physical activity at your own risk.

3. Account Registration

You create an account by signing in with Apple, Google, or email. You are responsible for activity under your account and for keeping your credentials secure. Accounts are personal and non-transferable.

Deleting your account does not cancel a store subscription — you must cancel through the app store separately.

4. The Service

PushMe provides personalized workout plans, AI-generated exercise videos, workout logging, progress tracking, and an AI coach. The Service is delivered inside the PushMe app and website only — never over WhatsApp, Telegram, or third-party messaging platforms.

We may modify, add, or discontinue features at any time. Exercise content and coach behavior are continuously improved.

5. Notifications

If you enable notifications, we send workout reminders, streaks, and coach messages. You can turn these off in the app or device settings. Standard carrier data charges may apply.

6. Intellectual Property

The PushMe brand, app, software, exercise library, and databases are owned by PushMe. You receive a limited, personal, non-exclusive licence to use the Service for your own training. You may not reproduce or redistribute PushMe's videos or programs.

7. Payments, Subscriptions & Auto-Renewal

7.1 Where to Buy

Subscriptions can be purchased in the app (App Store or Google Play) or on the web at start.trypushme.com.

7.2 Auto-Renewal

Subscriptions automatically renew unless you cancel. Your payment method is charged at the then-current price. If your plan includes a free trial, you will be charged automatically when the trial ends unless you cancel before it ends.

7.3 Refunds

• Apple purchases: Refunded by Apple at reportaproblem.apple.com
• Google Play purchases: Usually refundable within 48 hours in Play history
• Website purchases: Non-refundable except where consumer law requires (including EU/UK 14-day withdrawal rights)

To request a refund, email info@trypushme.com with your purchase details. We respond within 2 business days.

8. User Restrictions

You agree not to reverse-engineer, resell, scrape, or redistribute the Service; share your account; use the Service to coach others; upload infringing content; or interfere with our systems.

9. Limitation of Liability

To the maximum extent permitted by law, PushMe is not liable for any injury, condition aggravation, or fitness failure. No results are promised. Fitness outcomes depend on your adherence, nutrition, sleep, genetics, and medical history.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in unlawful activity. You may delete your account at any time.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without prejudice to your local consumer-protection rights and courts.

12. Apple & Google

These Terms are between you and PushMe, not with Apple or Google. If you purchased through an app store, that store's terms also apply, and Apple or Google are third-party beneficiaries with the right to enforce these Terms against you.
